If a smoker can sue the tobacco indestry for $100s of millions because they got lung cancer, can i sue?
can i seu Pepsi or Coca-Cola for rotting my teeth and gums for the same amount. I've noticed there are no warning labels on their cans or bottles or anything that says to brush your teeth when you are finished with their product. I can use $100s of millions. Are there any lawyers available who would take my case?

You can't sue for Hundreds of millions. The tobacco suit was a class action suit. States got the money. It is up to you to brush you teeth YOU need a label for that. Geeeeeeeeeez.

Depends, do you have lung cancer? Possibly caused by the tobacco company if so then yes...will you win...probably not. They will drag it out so long expecting you to die first. If you healthy then no, you can't.

Man if you are in USA you can sue who you like. But, do you have a big enough pool of money to take them on.

Every lawsuit against tobacco companies by consumers or their families has failed. What brought down the tobacco companies was a man named Robert Blakey. He was instrumental in writing the RICO statutes that put the Mafia out of business. Those RICO statutes were then modified and applied against the tobacco industry in general. It was so successful that influential people realized that the RICO statutes could be successfully used against anyone at anytime for any reason. For that reason, legislation was passed to prevent a recurrence of such tactics against any other legitimate industry. But I gotta admit, if I could, I'd sue the liquor companies for all the ugly women I woke up next to, the following morning.

There were plenty of smokers who found a lawyer even after everyone knew about what smoking did to the lungs. It took a long time before the judges cut that foolishness out. It was done again with McDonald's and the "everything makes you fat" suing craze. I see no reason you can't find a lawyer somewhere to take the case. Of course you have to wait until your teeth look like "all to be d*mned" before you can sue. You're going to need "Exhibit A" to show the jury so they can be horrified and immediately hand you millions of dollars. Better hurry. Now that you've broadcasted the idea and others have heard it, time is short before somebody beats you to this.

well yes but there are lots of people with the same problem and they dont do nothing about it so I guess you can do something but no guaratees ok. But you got a good point there my friend who knows you may get lucky. But they are going to ask for facts and prove that they caused the problem that is the thing can you prove it beyond reasonable doubt you got it win if you cant start looking for facts and good luck

probably not for millions. the suit agains the tabacco industry was a class action suit, meaning that money was split up between lots of people. you'd have to prove that pepsi/coke was the ONLY thing that made your teeth rot. if you're not brushing your teeth, then every other thing you eat is doing the same. So, they would only be partly to blame. Then, you'd have to prove that you had some 'loss' caused by the company. This would probably just be your teeth. So, unless you get a very good, very expensive lawyer, they may pay for part of your dental work, but not all of it because other food companies added to the loss.

Since they stopped putting cocaine in Coca-Cola it is no longer addictive. You couldn't sue for rotting teeth any more than Dunkin Donuts patrons can sue because they get fat eating them.

Yes you can certainly try. After all .......it IS the "american Dream" To win a wrongful death or injury law suit. Especially if you can get a lawyer to take your case on a continjency basis.

Heck I should be able to sue McDonald's for making me fat! lol, no you can't sue over that in theory what you say is right and logical but they don't allow it. I think it's silly people can sue the tobacco companies and win over doing something they did willingly.

I have a question about radiation treatments for lung cancer

I have a question about radiation treatments for lung cancer.?
My sister has ulcerations in her esophagus from radiation and she cannot eat or drink anything. She has been on a feeding tube for 3 weeks. Now she seems to have a really bad smell coming from within. Any ideas what this is about? I just got back from the hospital. They did a CT scan and found a new 8mm mass on the right back side of the base of her skull. Tomorrow they are doing an MRI. I fear the cancer has spread to her brain.

Bad smell can come from a variety of sources. Given the history of the ulceration, it is imsportant to see if this is the primary cause. bacteria can build up and emit an odor. Most bad smell come from food decay but since she is on a feeding tube , that is less likely so. Radiation therapy can kill a lot of cells and that could lead to smell as well . They can only link that people who smoke have a much higher rate of cancer. What the tobacco companies argue is that no one has proved the cause and effect of smoking. Not everyone who smokes gets cancer, it only increases your risk. Not to say smoking is a good idea!

To amplify the first answer. The first way is a crude link by comparing incidence in smokers to incidence in non-smokers. Then the data is refined in various ways - first you might look for a dose response by looking for increased incidence in those who smoke heavily for a number of years. Then you might try a group study by taking people from various groups e.g. men from socio-economic group 5 with ... and seeing whether the same behaviour is seen. This helps to isolate other factors, such as poverty, occupation etc which may also affect the incidence of cancer. You might also go on to look at cell culture studies or animal studies to see if a mechanism for a component of tobacco or its combustion product produce cancers or the sort of cell changes which precede cancers. It gets complicated and the first answer was quite right - it raises the risk. So all smokers will not get cancer but the chances of a smoker getting cancer are greater than if that same person was a non-smoker.

Cancer is an ancient disease . . so not exactly sure what you are talking about . . I suppose you could credit Greek physician Hippocrates (460-370 B.C.) with the origin for the word cancer. As far as scientists go there are a number of names . . none specific to lung cancer, but cancer in general who were instrumental in identifying cancer throughout the ages. Symptoms of lung cancer: -chronic cough -blood in sputum -lost weight -poor appetite -smoking.... very important risk factor There is one type of lung cancer that usually occur in non smoker called adenocarcinoma of the lung. But, still, in that type of cancer, age is the risk factor. 16? Too young to have that. Except the primary source of the cancer is not the lung but from other organ.

Pain control is paramount in this situation. This is a possible Hospice situation - if the malignant disease is as advanced as described. I have not seen this person. I don't know the tumor burden in the lungs, brain and liver. His doctors know his case FAR BETTER than we can know it over the internet. Hospice situations involve people with expected survivals of less than six months. Usually liver involvement means less than six months, BUT each person is different and this person could do better than the averages suggest. Spleen is an unusual place for metastatic non-small cell lung cancer. Are you certain the spleen is involved? Chemotherapy is never a cure in these situations. In some cases it may do more harm than good for this type of cancer at this stage in my experience over 20 years as a cancer specialist MD. It will be up to the patient and his doctors to decide whether to try chemotherapy for palliation to perhaps buy some extra months of survival time. The pros and cons are very close to canceling each other out in this situation.

chemo is not the easiest time spent. spreedog has excellent answer. it is always a difficult but individual decision.

My sister passed last June from NSCLC that spread to the brain and spinal fluid. She was diagnosed in 2002, and had a good long run. Once it got to the brain and into the spinal fluid, she went quickly. She tried a chemo drip for the spinal fluid and radiation for her brain tumors, but both treatments didn't do any good and left her feeling weak and tired. Depending on how the patient is feeling, from my personal take on this, I wouldn't do chemo. I think it accelerates the passing. Try palliative medication for the pain. I know this is a difficult time....

It's not great but there's always hope. I'd definitely work on getting on top of his pain. Chemo will be up to him and his doctors. I have a different cancer with mets and when we decided on quality rather than quantity of time I stayed on an oral chemo I could do from home. It'll never cure me but it will hopefully slow things, and it helps mentally for me to know that I'm doing something to actually fight it. I've also had radiotherapy in a palliative sense to try and reduce pain. Is he on dilaudid and or oxy? One other pain killer that's been great for me is fentanyl in a duragesic skin patch - is that an option? Feel free to send an email if you/he ever want to talk.
